“This Is What Totalitarianism Looks Like” – RedState

Actor-Director-Producer Nick Searcy is at Tinhorn Flats Burbank videoing the fascistic actions by Los Angeles County and the City of Burbank against this family-owned business.

Searcy posted to Twitter his viral video of a locksmith padlocking the doors of Tinhorn Flats in Burbank, California. Two police officers stand to the side watching the locksmith and looking around. According to Searcy, they are here to arrest owner Lucas Lepejian because he continues to operate his family restaurant despite temporary restraining orders issued by the Superior Court of Los Angeles, the Los Angeles Department of Health pulling the restaurant’s health permit, and the City of Burbank revoking its conditional-use permit, while cutting off the building’s electricity.

Lepejian has been operating with generators supplied by patrons and supporters, and has kept the business open, despite the City’s insistence on shutting it down.

NICK: So we’ll see how long this lasts.

They’re padlocking the doors again.

Woman: We got Nick Searcy here supporting.

NICK: [Laughs] That’s right.

I’m trying to get some more people to come. Because this is what it looks like. This is what totalitarian government looks like. They’re here to arrest this man for running his business. They’re claiming he doesn’t have proper electricity when they turned his electricity off. That’s how totalitarian government works. They make up the rules as they go, and they enforce them selectively, as they wish. Come down here, NOW! Witness this. This is tyranny.

Lepejian issued a call to action on the restaurant’s Facebook page, asking for everyone to come down to support and peaceably protest. Lepejian cut the locks at 2:00 p.m. and opened his doors.

NBC Los Angeles has kept abreast of the Battle of Tinhorn Flats. On March 26, Superior Court Judge Mitchell L. Beckloff chose not to issue any further action on the restaurant. He simply extended the temporary restraining order issued on March 8 to the next scheduled hearing date of April 9. The judge also requested that Tinhorn Flats and the City of Burbank seek to resolve their differences.

A judge Friday took no further action against a Burbank restaurant that has repeatedly defied orders to close, telling the parties he was leaving his temporary restraining order in effect pending another hearing next month while the city and eatery try and resolve their dispute.

Los Angeles Superior Court Judge Mitchell L. Beckloff had been scheduled to rule on whether to issue a preliminary injunction against the Tinhorn

Flats Saloon & Grill on Magnolia Boulevard and consider levying sanctions against the operators who defied health orders and continued to offer outdoor dining at a time it was banned in Los Angeles County as a way of limiting the spread of the coronavirus.

Beckloff instead extended the TRO he handed down March 8 until the next hearing on April 9.

The Los Angeles County Department of Public Health previously revoked the eatery’s health permit, and the Burbank City Council last month revoked its conditional-use permit. The TRO requires the business to stay closed until it obtains the legally required permits to reopen.

The city maintains the restaurant is an ongoing public nuisance.

Along with the Burbank City Council, not all Burbank residents support the restaurant’s stand for freedom.
